Canada’s Anti Spam Legislation (CASL)


At McEvoy, Lelievre and Associates, we want to help our clients keep up-to-date on important business issue’s. This article is about the new Canadian Anti-Spam Legislation, which took effect July 1, 2014.


The majority of Canada’s Anti-Spam Legislation deals with the installation of computer programs, which comes into force on January 15, 2015. However, there are other sections that deal with the private right of action that came into force July 1, 2014.

CASL affects any individual, business, or organization that:

  • Makes use of commercial electronic messages or CEMs
  • Produces or installs computer programs
  • Is involved with the alternation of transmission data.

Canada is actually one of the last developing countries to implement anti-spam legislation on a federal level. Even though it might be late on implementing such a law, Canada is making up for lost time by assembling one of the strictest and most aggressive laws yet in this area. Penalties for failing to comply can result in up to $10 million per violation.
